Rotterdam Guarantee Form 2008
The Netherlands are often described as an “arrest paradise” since it is relatively easy to obtain leave from the injunction judges of the Dutch courts to place prejudgment arrests on assets. Some of the most commonly placed arrests are ship arrests, bunker arrests and third party arrests.

Also other security measures can be exercised such as exercising a lien on cargo or sub-freight, etc.

Under Dutch law, an arrestor or a party that exercises a lien is in principle held to lift a placed prejudgment arrest and to refrain from further exercising the lien when adequate security is put up on behalf of the arrestee / debtor.

Especially in shipping related matters the most commonly used guarantee form in the Netherlands is the Rotterdam Guarantee Form 2008 which is available in the Dutch and the English language.
